Terms & Conditions

The terms under which Mega Power Services Pty Ltd (ACN 640 525 186) provides electrical, air conditioning, solar, security and related trade services across Sydney, NSW.

Definitions and interpretation

In these Terms and Conditions, unless the context otherwise requires:

ACL
The Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Agreement
The contract between you and us for the provision of Services, comprising these Terms and any Quote, Work Order or written confirmation we provide to you.
Business Day
Monday to Friday, excluding public holidays in New South Wales.
Consumer
Has the meaning given in section 3 of the ACL.
Consumer Guarantees
The consumer guarantees set out in the ACL.
GST
The goods and services tax imposed under A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Personal Information
Has the meaning given in the Privacy Act 1988 (Cth).
Quote
A written estimate or quotation for Services provided by us, whether given by email, in our job management system, or on paper.
Services
Any electrical, air conditioning, refrigeration, solar, EV charging, data, communications, security, CCTV, Level 2 ASP or related trade services we provide to you.
We, our, us

You, your
The person or entity engaging us to provide Services.

Headings are for convenience only and do not affect interpretation. Unless stated otherwise, a reference to a law includes any amendment, replacement or regulation made under that law.

These Terms and Conditions are issued by Mega Power Services Pty Ltd, Australian Company Number 640 525 186, based in Sydney, New South Wales.

We hold the following licences and accreditations:

  • Level 2 Accredited Service Provider 326250C
  • Electrical contractor licence 497290C
  • Refrigeration licence AU55381
  • Security licence 000244927

Our services

We provide the following trade and technical services across Sydney and surrounding regions:

  • Electrical installations, repairs and maintenance
  • Level 2 ASP metering, disconnection, reconnection and service mains work
  • Switchboard and single- to three-phase power upgrades
  • Air conditioning installation, servicing and repairs
  • Commercial refrigeration support
  • Solar panel and battery system installation
  • EV charger installation for residential and commercial sites
  • Data and communications structured cabling
  • Security and CCTV system installation and integration

The specific scope of Services will be set out in the Quote or Work Order we issue to you. Any variation to that scope must be agreed in writing, including by email.

Quotes and estimates

Quotes for planned work are provided free of charge and without obligation. A Quote is an estimate based on the information available at the time of assessment, including site conditions we can reasonably observe, and may be subject to a physical site visit. Quotes are valid for 30 days from the date of issue unless stated otherwise.

A Quote does not constitute a binding contract until you accept it in writing (including by email, SMS or through our job management system) and we confirm the booking. We reserve the right to withdraw or amend a Quote before acceptance.

Variations: if, after commencing work, we discover conditions that were not apparent at the time of quoting — including concealed damage, non-compliant existing work, asbestos, structural issues or access difficulties — we will:

  • Notify you of the issue and the estimated additional cost before proceeding; and
  • Only proceed with the variation work once you have approved it in writing.

If you request changes to the scope of work after accepting a Quote, those changes are treated as a variation and may incur additional charges. We will advise you of any additional cost before carrying out variation work.

Emergency and after-hours attendance

Emergency and after-hours call-outs are a chargeable attendance, not a free quote. Attendance covers travel, arrival on site, and the fault-finding required to make the site safe and identify the cause.

We will confirm the attendance rate with you before we are dispatched, and we will confirm the price of any repair work before we carry it out. If the repair proceeds and further planned work is required, the quote for that planned work is free.

Pricing and payment

All prices quoted are in Australian dollars (AUD) and are inclusive of GST unless stated otherwise. The total amount payable is clearly shown on your Quote or invoice.

Payment terms:

  • Payment is due on completion of the Services unless alternative terms have been agreed in writing.
  • For larger projects, we may require a deposit before commencing work. Any deposit requirement will be specified in your Quote.
  • For commercial and trade account clients, standard account terms are 14 days from the invoice date unless otherwise agreed in writing.

We accept payment by:

  • Credit or debit card (Visa, Mastercard), processed securely through Stripe
  • Electronic funds transfer (EFT) to our nominated bank account
  • Other methods as agreed in writing

Late payment: if payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the rate prescribed by the Supreme Court of New South Wales, calculated daily from the due date until payment is received in full. We also reserve the right to suspend further Services until outstanding amounts are paid.

Title: title to any goods or materials supplied as part of the Services remains with Mega Power Services until payment has been received in full.

Cancellations and rescheduling

We understand that plans change. Our cancellation and rescheduling policy is designed to be fair while protecting our ability to serve all clients:

  • You may cancel or reschedule a booked service at no charge by giving at least 24 hours' notice before the scheduled appointment time.
  • If you cancel or reschedule with less than 24 hours' notice, we reserve the right to charge a cancellation fee of up to $150 (including GST) to cover our scheduling and travel costs.
  • If our electrician arrives on site and cannot access the property, or the work cannot proceed due to circumstances within your control that you did not tell us about, a call-out fee of up to $150 (including GST) may apply.
  • We will always endeavour to be reasonable and will consider exceptional circumstances, such as genuine emergencies, case by case.

Warranties and guarantees

Lifetime workmanship warranty: we warrant our workmanship — that is, our labour — for the lifetime of the installation. If a defect arises in our workmanship, we will rectify it at no cost to you. This warranty is subject to:

  • The defect being attributable to our workmanship, and not to normal wear and tear, misuse, neglect, storm or surge damage, or modification by others;
  • You notifying us of the defect within a reasonable time after it becomes apparent;
  • The original work having been paid for in full;
  • The warranty being held by the original client. It is not transferable on sale of the property unless we agree otherwise in writing.

Manufacturer warranties: products and equipment we supply — such as air conditioning units, solar panels, EV chargers and security cameras — are covered by the manufacturer's warranty. Terms and duration vary by product and brand. We provide the relevant warranty documentation and assist you with any manufacturer warranty claim.

Australian Consumer Law: our goods and Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are entitled to have the Services remedied if they are not rendered with due care and skill, or are not fit for purpose.

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the ACL or any other applicable law that cannot be excluded, restricted or modified by agreement.

Limitation of liability

To the fullest extent permitted by law, and subject always to the Australian Consumer Law and any other non-excludable rights you may have:

  • Our liability for a breach of a Consumer Guarantee is limited, at our option, to the re-supply of the Services or the payment of the cost of having the Services re-supplied.
  • We are not liable for any indirect, consequential or special loss or damage, including loss of revenue, profit, business opportunity or data, arising from or in connection with the provision of our Services or your use of our Website.
  • We are not liable for loss or damage caused by factors beyond our reasonable control, including pre-existing defects at your property, failure of third-party equipment or materials, power surges or outages, or your failure to follow our advice or instructions.
  • Our total aggregate liability to you in connection with any Services is limited to the total amount paid by you to us for those specific Services.

Safety and site conditions: you are responsible for ensuring the work site is safe and accessible. You must inform us of any known hazards — including asbestos, concealed services and structural issues — before we commence work. We reserve the right to refuse to work in unsafe conditions.

The limitations in this section do not apply to liability for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be excluded or limited under applicable law.

Intellectual property

All intellectual property rights in our Website, brand name ("MEGA POWER SERVICES"), logo, marketing materials, Quotes, designs, reports and documentation we create remain our exclusive property. You may not reproduce, distribute or use any of our intellectual property without our prior written consent.

Any designs, plans or reports we produce for your project are provided for your use in connection with the Services only. You must not provide them to third parties for commercial purposes without our consent.

Website use

By using our Website, you agree that:

  • The content on our Website is for general information only. While we endeavour to keep it accurate and up to date, we make no warranties about its completeness, accuracy or reliability.
  • Our Website may contain links to third-party websites. We do not control and are not responsible for their content or privacy practices.
  • You must not use our Website in any way that is unlawful, fraudulent or harmful, or that could damage or impair its availability or accessibility.
  • We do not guarantee that our Website will be available at all times. We may suspend or restrict access for maintenance, security or other operational reasons.

If you submit information or upload files through our Website, you warrant that the material is accurate, not misleading, free of malicious code, and that you have the right to share it with us. You grant us permission to use that material for the purpose of quoting and performing the Services. Do not upload material that is confidential to a third party or that you are not permitted to disclose.

Your submission of personal information and files through our Website is governed by our Privacy Policy.

Dispute resolution

We value our relationship with our clients and are committed to resolving concerns fairly and efficiently. If you have a concern about our Services, please contact us directly in the first instance.

1. Notification
The party raising the dispute must notify the other in writing, setting out the nature of the dispute and the outcome sought.
2. Negotiation
Within 10 Business Days of receiving the notice, the parties must meet (in person or by phone) and attempt to resolve the dispute in good faith.
3. Mediation
If the dispute is not resolved within 20 Business Days, either party may refer it to mediation administered by the Law Society of New South Wales or another agreed mediator. Mediation costs are shared equally unless otherwise agreed.
4. Court proceedings
Neither party may commence court proceedings, except for urgent injunctive relief, until they have complied with the process above.

Nothing in this clause limits your right to lodge a complaint with a relevant regulatory body, such as NSW Fair Trading, or to pursue your rights under the ACL.

Governing law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You and we irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia (Sydney Registry).

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.

Force majeure

Neither party will be liable for any failure or delay in performing its obligations under these Terms to the extent that the failure or delay is caused by events beyond its reasonable control, including acts of God, severe weather, natural disasters, fire, flood, pandemic, government restrictions, industrial action, power outages or supply chain disruptions. The affected party must notify the other promptly and take reasonable steps to minimise the impact.

Changes to these terms

We may update these Terms and Conditions from time to time. The current version will always be available on our Website, and changes take effect from the date they are published.

For existing agreements, the Terms in effect at the time you accepted your Quote continue to apply to that agreement, unless we agree otherwise in writing. By continuing to use our Website or engaging us for new Services after changes are published, you accept the updated Terms.
